From the USA into Germany: what actually works differently

The product may be the same, but invoicing, data and advertising rules are not. Most US companies discover this after entering, and discovering it late costs more.

A German invoice is not the same document

Mandatory fields, how tax is shown and numbering rules differ from a US sales invoice. On top of that comes the e-invoicing obligation: producing a structured format, handing it to accounting and archiving it audit-proof. That is a change to the flow, not a setting in your billing system.

On the data side, the question is your certification

A framework exists for transfers between the EU and the US; whether your company can rely on it depends on certification, and that is a legal question. The consequence on our side is that which data crosses the Atlantic must be visible from the start, and where possible the architecture should not require the transfer at all. The assessment goes to partner law firms.

Reaching the German market does not require a German entity

The product side and the marketing side can move separately. Our sister brand OzyCore Studio produces video and advertising for the German market and runs creator campaigns for the Turkish-speaking audience in Germany. None of that requires a German entity on your side; the campaign, disclosure and reporting happen in Germany.

  • Whether marketing is run in Germany or remotely
Do we have to form a German company to reach the German market?

Not in every case. Campaigns, content production and advertising do not require a German entity on your side. Permanent sales, issuing local invoices or hiring change the answer, and that is a legal assessment we settle with a partner law firm. If formation is needed, it runs through our partner practice.

Is the time difference a problem?

In practice no, because most of the German-side work has to run on German time anyway: notary, register, bank, accounting, filming. The practical model is holding decision calls in the overlapping hours and letting us run the German side outside them.
